A Waiver is granted at the discretion of a U.S. Immigration Officer, who will weigh your application on the seriousness of your offence(s), your purpose for entering the U.S., and the risk of harm to the U.S. if you are admitted.
There is no eligibility period specified for a Waiver. Waivers are usually good for a period of 5 years; however, this is at the total discretion of the USCIS and, depending on the circumstances, they may be issued for a shorter period of time.
